Athlete & Parent Agreement with Spike Center LLC

Terms of Service, Release of Liability, Photo and Video Release

Please read these Combined Terms and Agreement ("Agreement") carefully before registering for or participating in the Spike Center Volleyball Training Program (the "Program"). By registering, all parties agree to be bound by these Terms and Agreement.

This Agreement is made between Spike Center LLC (the "Program"), the registered athlete ("Athlete"), and the Athlete's parent(s) or legal guardian(s) ("Parent/Guardian").

By clicking the "I agree to the Terms and Conditions" box, all parties acknowledge their understanding and commitment to the terms and conditions outlined below.

1. Program Overview and Our Philosophy

The Spike Center Volleyball Training Program is dedicated to developing a well-rounded volleyball player with a stronger spike, better ball control and a positive energy.

Our philosophy:

  • Have a Growth Mindset: Being coachable, applying lessons learned, and failing with a positive attitude

  • Become Athletic: Training strength, mobility, and nutrition daily to build the body of a high performing athlete

  • Develop Ball Control: Increasing accuracy on targets, the speed of a spiker, and the confidence in athletes

  • Be Respectful to All: Be honest, open to other people's ideas, and have respect for opponents, coaches, and officials.

  • Keep Trying: Getting better by constantly putting in your best effort everyday.

2. Registration and Payment

  • Eligibility: Participants must meet the age and skill requirements specified for each program level.

  • Registration: All participants must complete the official registration form and provide accurate and complete information.

  • Fees: Program fees are due monthly starting at the time of registration unless a payment plan has been explicitly agreed upon with Spike Center LLC staff. For refunds, see Refund Policy (Section 6).

  • Late Payments: A late fee of $20 will be applied for payments not received by the 8th of the month when it is due.

3. Athlete's Commitment

As an Athlete in the Spike Center Volleyball Training Program, I agree to:

  • Ready Up: Be present and be early for all scheduled training sessions, practices, and events, appropriately dressed in athletic clothing and wearing athletic shoes. If I cannot attend, I will notify my coach or program staff as far in advance as possible.

  • Stay Hydrated: Drink water throughout the day and bring my water bottle everywhere I go.

  • Lock in: Focus on and off the court, constantly striving to improve my skills and physical well-being.

  • Be Coachable: Actively listen to coaches, accept constructive criticism, and apply feedback as soon as possible.

  • Perform the Homework: Complete each assignment in a timely manner and use the recourses provided to me.

  • Show Respect: Treat my coaches, teammates, opponents, officials, and facility staff with respect at all times.

  • Be a Team Player: Support all athletes, communicate my thoughts often, and help others when I can.

  • Follow Rules: Adhere to all program rules, facility rules, and the rules of volleyball.

  • Maintain Good Attitude: Avoid any behavior that is disruptive, aggressive, violent, and disrespectful.

  • Care for Equipment: Treat all program equipment and facilities with care.

  • Communicate with Coach: Talk to coach and use the community board to ask questions.

  • Represent the Program: Be proud, act in a positive manner, and display the values of Spike Center.

4. Parent/Guardian's Commitment and Expectations

As the Parent/Guardian of the Athlete, I agree to:

  • Communicate with Coach: I will message any questions or concerns through the BAND app, by texting coach at (510) 617-1096, or scheduling a Zoom meeting. Coach will respond Monday through Friday, and not on weekends.

  • Support My Athlete: Encourage my child's dedication, sportsmanship, and effort into becoming a better player.

  • Ensure Attendance: Ensure my child arrives on time or early for scheduled sessions and events, and provide timely notification to coach for any absences.

  • Meet Financial Obligations: Ensure all program fees are paid in full by the specified deadlines.

  • Ensure Health and Safety: Provide accurate and complete medical information for my child during registration and keep the program updated on any changes. I understand and accept the inherent risks associated with athletic participation as outlined in this Agreement.

  • Read Program Communications: Stay informed by reading all communications from Spike Center regarding schedules, policies, and events.

5. Health and Safety, and Waiver of Liability

  • Medical Information: Parents/guardians must disclose any relevant medical conditions, allergies, or health concerns of the participant during registration.

  • Medical Treatment: In the event of an injury or medical emergency, Spike Center LLC staff will administer appropriate first aid and, if necessary, seek emergency medical treatment. By registering, you authorize Spike Center LLC staff to act on your behalf in seeking medical attention for the participant.

  • Assumption of Risk: Participating in sports activities, including volleyball, carries inherent risks of injury. While Spike Center LLC takes reasonable precautions to ensure participant safety, by registering, you acknowledge and assume all risks associated with participation in the Program.

  • Insurance: Participants are encouraged to have their own medical insurance. Spike Center LLC does not provide medical insurance coverage for participants.

  • Release of Liability: By registering for the Program, you, on behalf of yourself, the participant, and your heirs, executors, and administrators, hereby release, waive, and discharge Spike Center LLC, its coaches, staff, volunteers, and facilities from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant while participating in the Program, whether caused by the negligence of Spike Center LLC or otherwise.

6. Refund Policy

  • Cancellations by Participant:

    • Full refunds will be issued for cancellations made 2 days prior to the start of the program.

    • No refunds will be issued for cancellations made after the program has begun.

  • Cancellations by Spike Center LLC: In the unlikely event that Spike Center LLC cancels a program, a full refund will be issued to all registered participants.

  • Medical Withdrawals: Refunds for medical withdrawals, accompanied by a doctor's note, will be considered on a case-by-case basis.

7. Program Expectations and Policies

  • Communication:

    • Coaches will communicate expectations, schedules, and important information to athletes and parents/guardians.

    • Parents/Guardians are encouraged to communicate any concerns or issues to the coaching staff privately and respectfully.

  • Disciplinary Action: Spike Center LLC reserves the right to implement disciplinary actions, including but not limited to, temporary suspension from participation or permanent dismissal from the program, for violations of this Agreement, without refund. Spike Center LLC also reserves the right to dismiss any participant from the Program who engages in disruptive, aggressive, or disrespectful behavior, without a refund.

  • Medical Emergencies: In the event of a medical emergency, Spike Center LLC staff are authorized to seek necessary medical treatment for the Athlete. Parents/Guardians will be notified as soon as reasonably possible.

  • Equipment: Athletes are responsible for bringing appropriate athletic attire and shoes to all sessions. Program-provided equipment must be treated with care.

8. Financial Responsibility

I, the Parent/Guardian, understand and agree to be solely responsible for all financial obligations related to my child's participation in the Spike Center LLC Volleyball Training Program, including but not limited to registration fees, any late fees, and costs for optional merchandise or events. I acknowledge that fees are non-refundable except as explicitly stated in the Refund Policy (Section 6).

9. Photo and Video Release

I, the Parent/Guardian, grant Spike Center LLC permission to use photographs and/or videos of the Athlete taken during Program activities for promotional, marketing, and archival purposes, including but not limited to use on our website, social media, and printed materials.

10. Intellectual Property

All coaching materials, drills, and training methodologies used in the Program are the intellectual property of Spike Center LLC and may not be reproduced or distributed without explicit written permission.

11. Amendments to Agreement

Spike Center LLC reserves the right to amend this Agreement at any time. Any changes will be posted on our website and will be effective immediately upon posting. Your continued participation in the Program after any such changes constitutes your acceptance of the new Agreement.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
